Kenyan president Uhuru Kenyatta could have been be the first sitting head of state to be prosecuted by the International Criminal Court. But the ICC failed. On December 5, the prosecutor dropped the case. Fatou Bensouda said she had insufficient proof of his involvement in the 2007-2008 post-election violence.

Two months earlier, a major rally took place on the steps of the ICC. A confident-looking Kenyatta was hailed by his followers, right after a status conference in The Hague.

According to the ICC prosecutor, witnesses have been intimidated, and the Kenyan government has not provided sufficient cooperation. Kenya denies this.

The Kenyatta case highlights the difficulties of prosecuting a sitting head of state.
